Nipomo Insulation provides residential and commercial insulation contracting services, including but not limited to spray foam insulation, attic insulation, blown-in insulation, crawl space insulation, wall insulation, air sealing, vapor barrier installation, and related services. Our services are provided in Nipomo, California and surrounding communities.
We reserve the right to decline any service request at our discretion, including requests outside our service area or scope of work.
All estimates we provide are based on the information available at the time of the assessment. An estimate is not a binding contract. Final pricing may differ from the estimate if conditions discovered during the work - such as hidden damage, additional materials required, or changes in project scope - differ from what was assessed.
We will notify you before proceeding with any work that would increase the final cost beyond what was estimated. You have the right to approve or decline additional work before it begins.
Prices quoted on our website, in advertising, or in general marketing materials are for informational purposes only and do not constitute a binding offer. A written estimate provided after an in-person assessment is required before work begins.
Scheduling is confirmed by mutual agreement between you and our team. We ask that you provide at least 24 hours notice if you need to cancel or reschedule a confirmed appointment. Late cancellations or no-shows may affect our ability to prioritize your project.
We reserve the right to reschedule work due to weather conditions, material availability, crew availability, or other circumstances beyond our control. We will contact you as early as possible if a reschedule is necessary.
If a deposit has been paid and you cancel before work begins, refund eligibility will be determined based on the circumstances and any costs already incurred, such as materials ordered or permits pulled on your behalf.
Payment terms will be specified in your written estimate or service agreement. Unless otherwise agreed in writing, payment is due upon completion of the work. We may require a deposit for larger projects before scheduling work to begin.
Accepted payment methods will be communicated at the time of your estimate. Invoices not paid within the agreed timeframe may be subject to a late payment fee.
If a project requires materials to be ordered in advance, we may require payment for those materials before they are purchased. This portion of the payment is non-refundable once the materials have been ordered.
To the fullest extent permitted by law, Nipomo Insulation shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our website, our services, or any materials or information provided. This includes, without limitation, damages for loss of profit, loss of data, or loss of use, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to services we perform shall not exceed the amount you paid for the specific service that is the subject of the claim.
We stand behind the quality of our workmanship. If a defect in our installation is identified within the warranty period specified in your service agreement, we will return to correct it at no charge.
Our workmanship warranty does not cover damage resulting from customer-caused changes, acts of nature, pre-existing conditions not disclosed at the time of estimate, or issues caused by third parties performing work in the same areas after our job is complete.
Manufacturer warranties on materials and products are separate from our workmanship warranty and are governed by the respective manufacturer's terms. We make no representation regarding the specific performance outcomes of any insulation product beyond what the manufacturer has established. The information on our website is provided "as is" without warranties of any kind, express or implied.
You agree to provide our crew with safe and reasonable access to the areas of your property where work is to be performed. This includes clearing stored items from work areas, securing pets, and ensuring utilities (water, electricity) are available as needed.
You are responsible for disclosing any known conditions that may affect the safety of our crew or the outcome of the work, including but not limited to the presence of asbestos, lead paint, mold, pests, or structural damage. Failure to disclose known hazards may affect your warranty rights and may result in additional costs to address those conditions.
If you have a concern about work we performed, please contact us directly first. We will make a good-faith effort to resolve any dispute quickly and fairly. Most concerns can be addressed through direct communication.
If we cannot resolve a dispute informally, both parties agree to attempt non-binding mediation before pursuing any legal action. Mediation will be conducted in San Luis Obispo County, California.
If mediation is unsuccessful, disputes will be resolved by binding arbitration in San Luis Obispo County under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent immediate harm.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. Any legal action not subject to arbitration under Section 9 shall be brought exclusively in the state or federal courts located in San Luis Obispo County, California.
